Please read these Terms of Use carefully before using the Service. By creating an account or continuing to use the site, you agree to be bound by these Terms.

1) NATURE OF THE SERVICE — SIMULATED CONVERSATIONS ONLY
• Entertainment & Remembrance. This Service generates AI-created dialogue intended solely for entertainment, reflection, and remembrance. It may simulate the mannerisms or “voice” of a person based on information you provide. It is not that person, nor is it any form of spiritual, supernatural, or afterlife communication.
• No Guarantee of Accuracy. AI-generated content may be incomplete, inaccurate, or misleading. You should not rely on it as factual or complete.

2) NO PROFESSIONAL ADVICE; NOT FOR EMERGENCIES
• No Medical, Mental-Health, Legal, or Financial Advice. The Service does not provide professional advice. Content is not a substitute for consultation with qualified professionals. Do not use the Service to make medical, legal, financial, or other professional decisions.
• Crisis & Safety. The Service is not intended for crisis situations. If you are in danger or considering self-harm, call local emergency services or a crisis hotline immediately.

3) ELIGIBILITY — 18+ ONLY
• Age Requirement. You must be at least 18 years old to create an account, use the Service, or submit content. By continuing, you represent and warrant that you are 18 years of age or older.

4) YOUR CONTENT & RIGHTS OF OTHERS
• Your Responsibility. You are solely responsible for content you submit (including names, photos, stories, audio, likenesses, and other personal data). Do not upload confidential, sensitive, or unlawful content.
• Permissions & Consents. You represent and warrant that you have all rights, permissions, and consents necessary to (a) submit your content; (b) allow us and our service providers to process it; and (c) simulate any person’s voice/style/likeness described in your content, including compliance with applicable publicity, privacy, and intellectual property laws (which may protect deceased persons in some jurisdictions).
• Prohibited Uses. You may not use the Service to defame, harass, or unlawfully impersonate any person; to create deceptive or fraudulent communications; or to infringe privacy, publicity, copyright, trademark, or other rights.

5) LICENSES YOU GRANT
• Content License. Solely to operate, improve, and provide the Service, you grant us a worldwide, non-exclusive, royalty-free license to host, process, reproduce, modify (e.g., reformatting for display), and display your submitted content, including allowing our subprocessors (e.g., cloud and AI providers) to do so on our behalf.
• Feedback. If you provide feedback or suggestions, you grant us a perpetual, irrevocable, royalty-free license to use it without restriction.

6) PRIVACY & DATA HANDLING
• Processing. Content may be transmitted to and processed by third-party infrastructure and AI providers to generate responses. See our Privacy Policy for details on categories of data, purposes, retention, and your choices.
• Sensitive Data. Do not submit government IDs, financial account numbers, health or medical records, or other sensitive data.
• Data Retention. Conversation logs and profile/topic data may be retained for product functionality, safety, troubleshooting, and compliance. You may request deletion as permitted by law and our Privacy Policy.

7) AI SAFETY, MODERATION, AND LIMITS
• Safety Systems. We may use automated and/or human moderation. We may block or filter content, terminate sessions, or suspend accounts for violations of these Terms.
• No Duty to Monitor. We are not obligated to monitor all content but may do so to enforce these Terms or comply with law.

8) INTELLECTUAL PROPERTY
• Our Rights. The Service (including software, interfaces, models, prompts, and generated layouts) is owned by us or our licensors and is protected by intellectual property laws. Except for your content, you receive a limited, revocable, non-transferable license to access and use the Service in accordance with these Terms.
• Reservation of Rights. No rights are granted except as expressly stated.

9) THIRD-PARTY SERVICES
• Providers. The Service may rely on third-party hosting, analytics, payment, or AI providers. Your use is also subject to those providers’ terms and policies. We are not responsible for third-party services and disclaim liability for their acts or omissions.

10) ACCEPTABLE USE
You agree not to:
• Use the Service for unlawful, harmful, deceptive, or discriminatory purposes;
• Attempt to access accounts or data without authorization;
• Copy, extract, scrape, or harvest data except through documented features;
• Reverse engineer or interfere with the Service’s operation;
• Bypass safety filters or content restrictions;
• Upload malware or attempt to disrupt or degrade the Service.

11) DISCLAIMERS
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF ACCURACY, RELIABILITY, NON-INFRINGEMENT, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

12) LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOST PROFITS, LOST SAVINGS, LOSS OF DATA, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID (IF ANY) IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $100.

13) INDEMNIFICATION
You agree to defend, indemnify, and hold harmless us and our affiliates, officers, directors, employees, and agents from and against any claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from or related to (a) your content; (b) your use of the Service; (c) your violation of these Terms; or (d) your violation of any law or third-party right (including rights of publicity and privacy).

14) TERMINATION & SUSPENSION
We may suspend or terminate access to the Service at any time for any reason, including suspected violations of these Terms. You may stop using the Service at any time. Sections that by their nature should survive termination (e.g., disclaimers, limitations of liability, indemnification) will survive.

15) CHANGES TO THE SERVICE OR TERMS
We may modify or discontinue the Service at any time. We may update these Terms from time to time. Material changes will be notified by posting a revised version with a new “Last Updated” date. Your continued use after changes become effective constitutes acceptance.

16) GOVERNING LAW; DISPUTE RESOLUTION
• Governing Law. These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws rules.
• Informal Resolution. Before filing a claim, you agree to try to resolve the dispute informally by contacting us and allowing 30 days to respond.
• Arbitration & Class-Action Waiver. Except for claims that qualify for small-claims court, any dispute arising out of or relating to these Terms or the Service will be resolved by binding, individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. YOU AND WE WAIVE ANY RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN A CLASS ACTION. You may opt out of arbitration by sending written notice within 30 days of first agreeing to these Terms; see Contact section.

17) EXPORT & SANCTIONS
You represent that you are not located in, under the control of, or a national or resident of any country subject to U.S. sanctions. You agree to comply with applicable export control and sanctions laws.

18) SEVERABILITY; ENTIRE AGREEMENT
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect. These Terms, along with any referenced policies, constitute the entire agreement between you and us regarding the Service.

• I understand the conversations are AI-generated simulations for entertainment and remembrance only, not professional advice or emergency support.
